How To Get A Divorce
By Leeanne Utiger Know how to get a divorce so you can finally rid yourself of that person you longer want to be connected to.
It is not really hard to get a divorce, depending on varying situations however. Sometimes it doesn't take very long at all to get a divorce, while in some cases it may take longer. It really does come down to what you and your 'soon to not be husband' have to sort out.
Anyway, regardless to all of that, I am simply going to tell you how to go about getting a divorce. You will also need to know ow much it is going to cost you to get a divorce. In regards to this, a courthouse or your lawyer can inform you of this.
You will need to file for a divorce to be able to get a divorce. This simply put, means, you will have to either go to your local courthouse and place on file, (on record) that you are wanting to get a divorce. You will have to supply a little information such as: when you got married, your name, his or her name, where you got married, how long you were married for and how long you have been separated for. Now you can begin to work more on how to get your divorce.
Once you have done this, you have filed for divorce. Now to get your divorce to go through, you will also need to supply the other persons delivery address. Divorce papers have to be serve by hand directly to that person. Divorce papers cannot be posted, nor can they be left on a doorstep somewhere. Often you will have to pay for the other party to either be found, or for an address for delivery to be located. Sometimes this can take a while, but you will just have to be patient. In saying that, it is often best, and will save you some money, if you can get the address details yourself.
You do not have to go through all of the procedures that I have mentioned above through the local or district courthouse to get a divorce. You can opt to go and file the divorce papers at your lawyers office with your lawyer. I advise this, then you know exactly what is going on, and if there are any difficulties, your lawyer is on hand to keep you informed and get to you any up to date information that comes to hand, as well as assist with anything he/she may have to assist you with.
Once the papers are all drawn up and have been hand presented to the other person involved, it is up to them to sign the papers and have them sent back, more than likely through their own lawyer. There is often a time limit for them to do this. They can opt to petition against the divorce papers, however if they do not have much to actually petition against, they are basically just trying to waste time. If they do not sign the divorce papers and simply ignore that you have served divorce papers against them, do not fear, you will still get your divorce that you want. Once the given time limit is up, if the other party has not responded in any way, the procedures in getting the divorce finalised will simply go ahead. You will be notified once this happens and have verification that you have in fact managed to get a divorce.
Once this all happens, you will once again be able to go back legally to your maiden name if you so choose to. Of course, you can drop the use of your once married name without doing it legally, but bear in mind, that for some places you will have to supply identification which would stand up as being legal. If you really do not want to ever have to use your once married name, it is suggested you legally have your surname changed as soon as possible.
