For one reason or another you may need or want to know how you can file a lawsuit. Read this article on further and you will learn exactly how you can now file a lawsuit for whatever reason.

When you first look into knowing how to file a lawsuit, you will discover that you can go straight to a magistrates court and file a law suit. It is however advisable, that you also consult your lawyer or attorney for further assistance and guidance when you want to know more about how to file a lawsuit and in fact file a lawsuit against another person or company.

When you learn how to file a lawsuit you will also learn what the magistrate court can let you file a lawsuit for. Some things can take not be taken to magistrate court when you file a lawsuit and will have to be dealt with elsewhere. You will discover that when you learn how to file a lawsuit in a magistrates court, you cannot file a lawsuit pertaining to the following: Domestic relations, Malicious Prosecution, Slander, land Boundary Disputes, Misconduct by Public Officers, Injunctions or Restraining Orders.

When you find out all the information you need on how to file a lawsuit become aware that as a plaintiff, (that's what you are classed as when you file a lawsuit), you will have to be residing in the country where the court is located, or the defendant resides in the country where the court is located, or whatever you are filing a lawsuit for, occurred in the country of where the court is located.

You will learn on finding out about how to file a lawsuit that you have to fill out a Civil Complaint form. You can ask for advice and help from your lawyer or attorney on how to fill out a Civil Complaint form if you need to. These forms can be picked up from the Magistrates Court Clerk.

When you gather all the information you need on knowing how to file a lawsuit, you will learn that as the plaintiff you will need to provide your correct name and physical address, as well as the defendants name and address. If you are not sure of the address of the defendant, you will some how have to try and locate it prior to filling out a Civil Complaint Form. You will learn how you will also have to provide the amount of money you are claiming for, along with a brief description of why you are making a claim in the first place and why you have filed for a lawsuit.

Knowing how and what to do with the application and claim next is of importance. You will need to take the filled out Civil Claims Form back to the Magistrates Court and hand it to the Clerk in the Clerks Office. The complaint and lawsuit you have learned how to file will then be filed and you will be given a Service Packet.

You will learn how you can request a jury trial if you so want there to be a jury present. You will also learn how there is a fee involved when you choose to file a lawsuit. You will also learn how you as the plaintiff have 10 days after the lawsuit has been filed to disqualify a judge. You will then learn how you will have to find someone to deliver the service packet to the defendant. This is notification that you are filing a lawsuit against them, and will also contain a summons to appear in court.
